Kenneth M. Katz is an income partner of the firm’s New York Office (Zumpano Patricios & Popok). Mr. Katz has broad experience handling complex and high-stakes litigation, cross-border disputes, regulatory enforcement actions, and investigations, including in the areas of employment and financial services. His nationwide work has included extensive hands-on experience in all phases of disputed matters in state and federal courts and in arbitrations.
Before joining the firm, Mr. Katz was Counsel at an international law firm based in New York where he gained substantial experience representing accounting firms, financial institutions, and professionals in civil and regulatory matters. Mr. Katz has represented clients in regulatory investigations by the U.S. Securities and Exchange Commission (SEC), the Public Company Accounting Oversight Board (PCAOB), the U.S. Commodity Futures Trading Commission (CFTC), and the CME Group. Mr. Katz also assisted clients in their internal investigations, including investigations of the clients’ compliance with SEC and CFTC regulations, anti-money laundering laws, and trading regulations.
Mr. Katz has also represented China-based clients in their disputes with U.S. companies. On behalf of his clients, he has asserted and defended claims arising out of contract, investment, and employment disputes, and has counseled clients on drafting contracts and potential exposure to U.S. litigation.

Won award in arbitration on behalf of clients that invested in failed project through the EB-5 Immigrant Investor Program.

Defended and asserted claims on behalf of Chinese manufacturers in disputes with U.S. companies.

Negotiated settlement of preference claims in bankruptcy proceedings.

Won dismissal of fraud and control-person securities claims against professional services firms.

Successfully persuaded regulators to decline commencement of enforcement proceedings.

Asserted indemnification claim on behalf of manufacturer in claims arising out of defective automobile part subject to worldwide recalls.

Won purchase price adjustment in arbitration regarding acquisition of chain of stores.

Won summary judgment for pharmaceutical company against contract claims arising out of acquisition of product.

Represented the trustee of Lehman Brothers Inc., in defending the trustee’s determination of one of the largest customer claims in the history of the Securities Investor Protection Act, and in curing the former broker-dealer’s failure to comply with customer protection rules.

Represented the Joint Administrators of Nortel Networks European entities through discovery and a trial that occurred simultaneously in Delaware Bankruptcy Court and Ontario Superior Court.
